人民网澳门7月30日电 （记者富子梅）《粤港澳大湾区仲裁员名册工作指引》文本30日发布。《指引》是由广东省司法厅、香港特区政府律政司及澳门特区政府行政法务司共同商定，并获粤港澳大湾区法律部门联席会议审议通过。

《指引》的出台将有助于推动大湾区仲裁员名册的设立，实现三地仲裁机构互认彼此所推荐的仲裁员，并纳入自身的仲裁员名册中，便利当事人跨机构选择仲裁员，进一步促进仲裁在大湾区内得到更广泛应用。

《指引》规定了推荐条件、入册程序、仲裁员名册的使用、在册仲裁员的监督与除名、自愿退出等内容。根据上述文件，仲裁机构向所在法律部门提交推荐仲裁员初选名单，经复核后，送交粤港澳法律部门联席会议作最终确定，并形成《粤港澳大湾区仲裁员名册》。

推荐条件包括六项，（一）拥护《中华人民共和国宪法》，拥护《中华人民共和国香港特别行政区基本法》《中华人民共和国澳门特别行政区基本法》；（二）职业道德良好，未有因不良名誉或者违反职业道德受惩处的记录；（三）获内地、香港或澳门其中两地的仲裁机构纳入其仲裁员名册；（四）具有累计五年以上担任仲裁员实务经验；（五）累计担任至少五宗仲裁案件的仲裁员并撰写仲裁裁决，其中至少三宗仲裁案件为跨法域仲裁案件；（六）熟练掌握普通话（或粤语）和至少一门中文以外的语言。

《指引》明确，联席会议可按被推荐人的实际情况豁免上述第（三）至（六）项中一项或多项条件要求。三地法律部门可结合本地实际，在上述统一推荐条件的基础上增加推荐条件，并向联席会议报备。

《指引》同时明确了在册仲裁员的监督与除名条款，有下列情形之一的，应予以除名，（一）发生危害国家安全行为或者损害社会公共利益的行为；（二）有严重违反法律、法规和仲裁规则、仲裁员职业操守的行为；（三）因违法被判处刑罚、开除（辞退）公职、吊销职业资格（执业证照）或被处以停止执业处罚而丧失任职条件；（四）应予以除名的其他情形。
